Scientists have known about Delta-10 THC for some time, but there hasn’t been much lab research focused on this cannabinoid. In May 2022 the 9th Circuit Court of Appeals held that Delta-8 THC fits that definition, and that reasoning appears to extend to other hemp-derived cannabinoids including Delta-10. Other federal courts could see it differently, so this is settled law in the 9th Circuit rather than nationwide.

Yes. Delta-10 is a form of THC, so it has the potential to produce a buzz. Users consistently report it isn’t as strong as Delta-9 or Delta-8, and describe it as more of a head effect than a full-body one.
The leading explanation is that Delta-10 binds CB1 receptors less tightly, which would account for the milder, clearer character users describe. Mellow is not the same as inactive, though — it is still intoxicating, and it will still show on a drug test.
